Misleading commercial practices are a criminal offence. Article L132-2 of the Code de la consommation, verbatim: "Les pratiques commerciales trompeuses … sont punies d'un emprisonnement de deux ans et d'une amende de 300 000 euros. Le montant de l'amende peut être porté, de manière proportionnée aux avantages tirés du délit, à 10 % du chiffre d'affaires moyen annuel … ou à 50 % des dépenses engagées pour la réalisation de la publicité … Ce taux est porté à 80 % dans le cas des pratiques commerciales trompeuses … lorsqu'elles reposent sur des allégations en matière environnementale." That 80% rate is the provision aimed squarely at greenwashing: the fine can reach four fifths of what the campaign cost to run. Where the practice is committed online the penalties rise to five years and EUR 750,000. For legal persons the amounts are multiplied under article 131-38 of the Penal Code. Separately, the carbon-neutrality advertising regime carries its own EUR 100,000 administrative ceiling. Verified against the DILA open data (LEGI) on 24 August 2026.
