Misleading commercial practices are a criminal offence. That 80% rate is the provision aimed squarely at greenwashing: the fine can reach four fifths of what the campaign cost to run. Where the practice is committed online the penalties rise to five years and EUR 750,000. For legal persons the amounts are multiplied under article 131-38 of the Penal Code.
