A small market with one central authority and, so far, little published green-claims enforcement. Low observed activity is not low legal risk, and the gap is closing on a known date: the Estonian transposition of Directive (EU) 2024/825 is adopted and enters into force on 27 September 2026 (redaction 103072026030), adding statutory definitions of 'keskkonnaväide' and 'üldine keskkonnaväide' to the Consumer Protection Act. Until then the general misleading-practice rules apply. A shop selling from Estonia into Germany is judged in Germany either way.

The Consumer Protection and Technical Regulatory Authority handles unfair commercial practices and advertising supervision in one body. It can require a practice to stop, issue precepts with penalty payments, and pursue misdemeanour proceedings. It publishes guidance and decisions in Estonian.

Tarbijakaitseseadus (Consumer Protection Act) implementing the UCPD — § 16 misleading and § 18 aggressive practices, penalties in § 70 — together with Reklaamiseadus (Advertising Act), which sets general requirements for advertising independently of consumer law.

Sanciones

Misdemeanour fines under the Consumer Protection Act. Since 13 July 2026 the ceiling for a legal person under TKS § 70(2) is EUR 400,000 for using a misleading or aggressive commercial practice. For acts committed on a large scale or EU-wide, TKS § 70(3) raises this to 4% of the previous financial year's turnover, or EUR 2 million where turnover figures are unavailable. Precepts carrying penalty payments run alongside the fines. Published green-claims fines are still rare — the practical pressure so far has come from precepts and from export markets.

Cross-border exposure

For most Estonian shops the first real test will come from a destination market — a German competitor's cease-and-desist or a French DGCCRF sweep — rather than from TTJA.

Directive 2024/825 transposition

Adopted, published as RT I, 03.07.2026, 19, and entering into force on 27 September 2026. Re-verified against Riigi Teataja on 13 September 2026: the redaction in force today (103072026029, in force 01.09.2026–26.09.2026) contains no occurrence of 'keskkonnaväide'; the successor redaction 103072026030, in force from 27.09.2026, uses 'keskkonnaväide' four times, defines 'üldine keskkonnaväide' and adds durability wording, together with the new Annex I blacklist. The 31 August 2026 amendment that produced the current redaction added § 18-1 on dark patterns in online interfaces for distance financial services contracts and left the environmental-claims position unchanged. The § 70 penalty increase to EUR 400,000 came earlier, on 13 July 2026, and is already in force.
