TTJA supervision practice
The authority's published work on misleading advertising has focused on price and availability claims; environmental claims have not yet produced a prominent public decision. Absence of decisions is not absence of rules.

Länder-Leitfaden
A small market with one central authority and, so far, little published green-claims enforcement. Low observed activity is not low legal risk, and the gap is closing on a known date: the Estonian transposition of Directive (EU) 2024/825 is adopted and enters into force on 27 September 2026 (redaction 103072026030), adding statutory definitions of 'keskkonnaväide' and 'üldine keskkonnaväide' to the Consumer Protection Act. Until then the general misleading-practice rules apply. A shop selling from Estonia into Germany is judged in Germany either way.
The Consumer Protection and Technical Regulatory Authority handles unfair commercial practices and advertising supervision in one body. It can require a practice to stop, issue precepts with penalty payments, and pursue misdemeanour proceedings. It publishes guidance and decisions in Estonian.
Tarbijakaitseseadus (Consumer Protection Act) implementing the UCPD — § 16 misleading and § 18 aggressive practices, penalties in § 70 — together with Reklaamiseadus (Advertising Act), which sets general requirements for advertising independently of consumer law.
Misdemeanour fines under the Consumer Protection Act. Since 13 July 2026 the ceiling for a legal person under TKS § 70(2) is EUR 400,000 for using a misleading or aggressive commercial practice. For acts committed on a large scale or EU-wide, TKS § 70(3) raises this to 4% of the previous financial year's turnover, or EUR 2 million where turnover figures are unavailable. Precepts carrying penalty payments run alongside the fines. Published green-claims fines are still rare — the practical pressure so far has come from precepts and from export markets.

Lokale Formulierungen
Übersetzte Texte werden in der Landessprache beurteilt, und die nationale Rechtsprechung hat bestimmten Begriffen bereits Bedeutung zugewiesen.
| Lokaler Begriff | Auf Englisch | Warum es hier zählt |
|---|---|---|
| jätkusuutlik | Sustainable | Generic claim; the Estonian form is heavily inflected (jätkusuutlikud, jätkusuutlikkusele) and all of it counts. |
| roheline | Green | Also the colour and a common proper noun. As a product claim it is generic. |
| looduslik | Natural | The most common Estonian green claim, especially in cosmetics. Natural origin is not a substantiated benefit. |
| keskkonnasõbralik | environmentally friendly | Generic claim — needs recognised excellent environmental performance. |
| ökoloogiline | Ecological | Read by consumers as implying certification; treated the same as “ecological” elsewhere. |
| kliimaneutraalne | climate neutral | Prohibited where it rests on offsetting (Annex I point 4c). |
| süsinikneutraalne | carbon neutral | Same treatment as kliimaneutraalne. |
| biolagunev | Biodegradable | Requires conditions, timeframe and test standard. |
| taaskasutatav | Recyclable | Technically recyclable is not the same as actually collected in Estonia. |
| kompostitav | Compostable | Industrial and home composting are different capabilities and must be distinguished. |
| plastivaba | Plastic-free | Usually false at component level: liners, seals and labels normally contain polymers. |
| heitmevaba | zero emissions | Absolute claim; defensible only for a named, genuinely emission-free stage. |
| taastuvenergia | Renewable | "Renewable" says the input regrows, not that the product is better. Without the share, the source and the certification it carries the weight of an environmental benefit it has not demonstrated — and for energy it needs a supplier-specific figure, not a national grid average. |
| keskkonnasäästlik | Gentle on the environment | A softened generic claim. Softening the wording does not narrow the scope — it still asserts low overall impact. |
| keskkonnahoidlik | Environmentally correct | Claims conformity with an unstated environmental norm. There is no such general norm, so the claim cannot be tested. |
| loodussõbralik | Nature's friend | A figurative benefit claim. Regulators read implied environmental claims the same way as explicit ones, and the figurative framing makes it harder, not easier, to substantiate. |
| keskkonnateadlik | Conscious | A vague virtue word used as a product tier name. Regulators have treated collection names like this as environmental claims subject to the same substantiation duty. |
| taaskasutatud | Recycled | The trap is scope: "recycled packaging" on a product with a virgin plastic bottle and a recycled outer sleeve is a partial benefit presented as a whole-product one. |
| kliimasõbralik | Climate friendly | Suggests a positive or neutral climate effect for a product that still emits. Where the basis is offsetting it also breaches the offsetting ban. |
| CO2-jalajälg | Reduced carbon footprint | Same defect as any bare reduction claim: no baseline, no boundary, no verification. |
| süsinikuneutraalne | Carbon neutral | Prohibited where it rests on offsetting, which is how virtually all such claims are built. The German Federal Court of Justice (BGH, I ZR 98/23) additionally requires the meaning of the term to be explained at the point of the claim. |
| mürgivaba | Non-toxic | Toxicity is dose-dependent and substance-specific, so a blanket "non-toxic" is not demonstrable. It also implies competitors are toxic. |
| roheline valik | Green choice | A steering label that tells the consumer this option is environmentally better without disclosing the criterion or the comparison set. |
| looduslikest materjalidest | Made from natural materials | Natural origin implies low impact, which does not follow — conventional cotton and leather are natural and impact-intensive. Scope is usually unstated too. |
| ökosõbralik | Eco-friendly | A blanket friendliness claim tells the buyer nothing measurable. It is only allowed where you can demonstrate recognised excellent environmental performance covering the whole product, which in practice means an EU Ecolabel or an equivalent Type I scheme. |
| maasõbralik | Earth-friendly | A planetary-scale benefit claim with no scope, no metric and no possible substantiation for an individual product. |
| keskkonnale ohutu | Not harmful to the environment | An absolute negative claim about all environmental compartments. It cannot be demonstrated for a manufactured good. |
| jätkusuutlikkus | Sustainability | Used as a product or badge label (“Sustainability score”, “Sustainability choice”) it is a generic claim and has to be substantiated. The word also has a legitimate use as the title of a real report or policy page — we cannot tell the two apart from the wording alone, so we flag it and leave the judgement to you. If this instance is a report title, mark it and move on. |
| kliimapositiivne | Carbon positive | Claims a net beneficial climate effect. In practice it always rests on purchased credits, which point 4c rules out as a basis for any neutrality, reduction or positive-impact claim. |
| CO2-vähendatud | CO2 reduced | A reduction claim is only meaningful against a stated baseline, scope and period. Without them the buyer cannot tell what was reduced or from what. |
| CO2-negatiivne | Carbon negative | An even stronger version of the neutrality claim, and equally dependent on credits. Point 4c covers neutral, reduced and positive impact claims based on offsetting. |
| CO2-kompenseeritud | CO2 compensated | Compensation is offsetting under another name; the prohibition follows the substance of the claim, not the wording. |
| vähese süsinikuheitega | Low carbon | "Low" is implicitly comparative and therefore needs a disclosed benchmark. Low compared to what, measured how? |
| CO2-neutraalne | CO2 neutral | Identical in substance to "climate neutral" and caught by the same prohibition and case law. |
| kliimakompenseeritud | Climate compensated | Same prohibition. Nordic regulators have been particularly active against this phrasing. |
| CO2-tasakaalustatud | Carbon balanced | "Balanced" implies emissions have been cancelled out — a neutrality claim built on credits. |
| kliimatasakaalustatud | Climate balanced | As above: a neutrality claim in softer wording, with the same legal treatment. |
| biopõhine | Bio-based | Bio-based says where the carbon came from, not that the product is compostable, recyclable or lower impact — yet consumers read all three into it. |
| kemikaalivaba | Chemical-free | Scientifically impossible — all matter is chemical. It plays on chemophobia and cannot be substantiated in any form. |
| rohelisem kui | Greener than... | A comparison is only fair if the buyer can see what was compared, on which impacts, using which data. "Greener" discloses none of it. |
| keskkonnasõbralikum | Eco-friendlier | Comparative form of a term that is already too vague in its base form. |
| jätkusuutlikum | More sustainable | A comparative with no baseline: more sustainable than what, measured how? |
| BPA-vaba | BPA-free | BPA toiduga kokkupuutes on EL-is piiratud — seaduse nõue esitatud eelisena. |
| CE-sertifitseeritud | CE certified | The CE mark is a condition of market access, not a quality or environmental credential. |
| loomkatseteta | No animal testing | Since 2013 no cosmetic may be tested on animals anywhere in the EU, so this advertises a legal requirement as if it set the product apart. |
| REACH-vastavuses | REACH compliant | Meeting REACH is not a feature — it is the baseline every seller in the EU already has to clear. Presenting it as a benefit is what point 10a of Annex I now forbids. |
| RoHS-vastavuses | RoHS compliant | RoHS applies to electrical and electronic equipment across the EU, so every competitor on the shelf is in the same position. Advertising it as an advantage is the practice point 10a lists. |
| CLP-märgistusega | CLP labelled | Hazard labelling under Regulation 1272/2008 is required for classified substances and mixtures. Advertising it implies a voluntary safety step. |
| ftalaadivaba | Phthalate-free | The main phthalates are restricted or authorisation-only under REACH Annex XVII and XIV, so for most consumer goods absence is the legal baseline. |
| jätkusuutlikkuse hinne | Own sustainability score | A self-calculated score is a sustainability label under the Directive. Self-issued rating systems are exactly what point 2a targets. |
| ringmajandus | Circular | Without a real take-back route this is an intention, not a property of the product. |
| kliimakaitse | Climate protection | Retsitaal 9 nimetab täpselt seda sõnaperet üldise keskkonnaväitena. |
| positiivne mõju keskkonnale | Positive impact | A net-positive claim — the strongest form a generic environmental claim can take, and the hardest to substantiate. |
| kooskõlas loodusega | In harmony with nature | Not measurable. It reads as an environmental benefit while committing to nothing. |
| vähendame oma mõju keskkonnale | Lower environmental impact | Võrdlus ilma lähtejooneta, ulatuseta ja suuruseta. |
| säästab ressursse | Resource-saving | Millist ressurssi, mille vastu, kui palju. |
| taastav põllumajandus, regeneratiivne põllumajandus | Regenerative | Matched as a phrase, not as a bare adjective. The adjective alone is ordinary vocabulary in technical and medical Estonian and carries no environmental claim. |

TTJA supervision practice
The authority's published work on misleading advertising has focused on price and availability claims; environmental claims have not yet produced a prominent public decision. Absence of decisions is not absence of rules.
Cross-border exposure
For most Estonian shops the first real test will come from a destination market — a German competitor's cease-and-desist or a French DGCCRF sweep — rather than from TTJA.
Directive 2024/825 transposition
Adopted, published as RT I, 03.07.2026, 19, and entering into force on 27 September 2026. Re-verified against Riigi Teataja on 13 September 2026: the redaction in force today (103072026029, in force 01.09.2026–26.09.2026) contains no occurrence of 'keskkonnaväide'; the successor redaction 103072026030, in force from 27.09.2026, uses 'keskkonnaväide' four times, defines 'üldine keskkonnaväide' and adds durability wording, together with the new Annex I blacklist. The 31 August 2026 amendment that produced the current redaction added § 18-1 on dark patterns in online interfaces for distance financial services contracts and left the environmental-claims position unchanged. The § 70 penalty increase to EUR 400,000 came earlier, on 13 July 2026, and is already in force.
