Sweden has one of the most active greenwashing enforcement records in the EU and a penalty that is purely turnover-based, with no fixed ceiling. The Patent and Market Court has repeatedly found vague environmental wording misleading, and Annex I of the UCPD is written directly into the penalty provision.

Konsumentverket / Konsumentombudsmannen (KO)
The Swedish Consumer Agency supervises marketing; the Consumer Ombudsman brings cases to the Patent and Market Court. Sweden also has an unusually strong private route: a competitor can sue directly under the Marketing Act, and often does.
Marknadsföringslagen (2008:486), which implements the UCPD. Section 29 makes a breach of the Act — or of Annex I to Directive 2005/29/EC — punishable by a market disruption fee; section 31 sets the amount.
There is no fixed euro ceiling. Section 31 of the Marketing Act sets the market disruption fee at "lägst tio tusen kronor och högst fyra procent av näringsidkarens omsättning" — a minimum of SEK 10,000 and a maximum of 4% of the trader's turnover in the financial year before the infringement ended. Section 29 makes the fee available for any breach of the Act or of Annex I to the UCPD, which is exactly where the environmental-claim blacklist sits. The fee is imposed by the Patent and Market Court on the Consumer Ombudsman's application. Separately, a competitor can obtain an injunction with a penalty attached, which in practice arrives faster than a fee. Verified against riksdagen.se on 24 August 2026.

Competitor actions
Because section 29 gives a private route, much of the Swedish caseload is competitor against competitor. The practical consequence for a shop is that the first contact may be a writ rather than a regulator's letter.
