Dichiarazioni verdi in Svezia

Sweden has one of the most active greenwashing enforcement records in the EU and a penalty that is purely turnover-based, with no fixed ceiling. The Patent and Market Court has repeatedly found vague environmental wording misleading, and Annex I of the UCPD is written directly into the penalty provision.

Chi applica

Konsumentverket / Konsumentombudsmannen (KO)

The Swedish Consumer Agency supervises marketing; the Consumer Ombudsman brings cases to the Patent and Market Court. Sweden also has an unusually strong private route: a competitor can sue directly under the Marketing Act, and often does.

Diritto nazionale

Marknadsföringslagen (2008:486), which implements the UCPD. Section 29 makes a breach of the Act — or of Annex I to Directive 2005/29/EC — punishable by a market disruption fee; section 31 sets the amount.

Sanzioni

There is no fixed euro ceiling. Section 31 of the Marketing Act sets the market disruption fee at "lägst tio tusen kronor och högst fyra procent av näringsidkarens omsättning" — a minimum of SEK 10,000 and a maximum of 4% of the trader's turnover in the financial year before the infringement ended. Section 29 makes the fee available for any breach of the Act or of Annex I to the UCPD, which is exactly where the environmental-claim blacklist sits. The fee is imposed by the Patent and Market Court on the Consumer Ombudsman's application. Separately, a competitor can obtain an injunction with a penalty attached, which in practice arrives faster than a fee. Verified against riksdagen.se on 24 August 2026.

Mercato

Vendere in Svezia

Dimensione
About 10.5 million consumers, among the highest online spend per head in Europe and a strong Nordic cross-border flow.
Contesto
Dominated by large domestic retailers and a dense layer of DTC brands. Swedish shops market heavily on sustainability, which means both a high volume of claims and a well-informed consumer base.
Dove stanno le dichiarazioni
Fashion, food and home are the loudest. Swedish marketing leans on 'hållbar', 'miljövänlig' and 'klimatneutral' — the last of which has already been litigated.

Pratico

Che cosa si aspetta da te questo mercato

  • A general environmental claim must be substantiated at the moment it is made; the Patent and Market Court has not accepted substantiation assembled after a complaint.
  • Annex I of the UCPD is written straight into section 29, so a blacklisted claim is directly sanctionable without any separate assessment of misleadingness.
  • Expect competitor enforcement. Sweden's private route is fast and widely used, and an injunction with a penalty attached usually lands before any public fine.
  • Substantiation must be available in Swedish.

Formulazioni locali

Termine locale In inglese Perché conta qui
hållbar Sustainable Sustainability is a whole-lifecycle property. Used as an adjective for a product it asserts excellence across every impact category, which needs lifecycle evidence almost no seller holds.
grön Green “Green” is the textbook generic claim: no scope, no metric, no verification. It is also a colour and a common proper noun, so a match here is a prompt to look, not a conclusion — check whether the word is doing any environmental work in the sentence.
naturlig Natural "Natural" reads as an environmental and safety benefit but has no legal definition outside food and cosmetics standards. Natural origin also does not make a substance harmless.
miljövänlig Environmentally friendly Same defect as "eco-friendly" in longer form. It claims net benefit to the environment as a whole while every physical product carries a footprint.
ekologisk Organic For food, feed and agricultural products the term is legally reserved for certified operators. Outside that scope it is an unsubstantiated quality claim.
ekovänlig Eco-friendly A blanket friendliness claim tells the buyer nothing measurable. It is only allowed where you can demonstrate recognised excellent environmental performance covering the whole product, which in practice means an EU Ecolabel or an equivalent Type I scheme.
klimatvänlig Climate friendly Suggests a positive or neutral climate effect for a product that still emits. Where the basis is offsetting it also breaches the offsetting ban.
klimatneutral Climate neutral The most litigated term in this list. Beyond point 4c, German case law (BGH klimaneutral, 2024) held the term ambiguous and misleading unless the basis is explained in the advertisement itself.
koldioxidneutral Carbon neutral Prohibited where it rests on offsetting, which is how virtually all such claims are built. The German Federal Court of Justice (BGH, I ZR 98/23) additionally requires the meaning of the term to be explained at the point of the claim.
CO2-neutral CO2 neutral Identical in substance to "climate neutral" and caught by the same prohibition and case law.
komposterbar Compostable Industrial and home composting are different capabilities, and most consumers have access only to the latter. Unqualified, the claim misdirects disposal behaviour.
återvinningsbar Recyclable Technically recyclable is not the same as actually collected. If no separate collection stream exists in the markets you sell to, the claim misleads.
återvunnen Recycled The trap is scope: "recycled packaging" on a product with a virgin plastic bottle and a recycled outer sleeve is a partial benefit presented as a whole-product one.
plastfri Plastic-free Frequently false at component level: adhesives, liners, coatings and labels usually contain polymers. It also implies an overall environmental benefit that a heavier alternative may not deliver.
kemikaliefri Chemical-free Scientifically impossible — all matter is chemical. It plays on chemophobia and cannot be substantiated in any form.
förnybar Renewable "Renewable" says the input regrows, not that the product is better. Without the share, the source and the certification it carries the weight of an environmental benefit it has not demonstrated — and for energy it needs a supplier-specific figure, not a national grid average.
hållbarhet Sustainability Used as a product or badge label (“Sustainability score”, “Sustainability choice”) it is a generic claim and has to be substantiated. The word also has a legitimate use as the title of a real report or policy page — we cannot tell the two apart from the wording alone, so we flag it and leave the judgement to you. If this instance is a report title, mark it and move on.
ansvarsfull Responsible "Responsibly made" or "responsible sourcing" asserts ethical and environmental diligence without naming the standard the diligence is measured against.
giftfri Non-toxic Toxicity is dose-dependent and substance-specific, so a blanket "non-toxic" is not demonstrable. It also implies competitors are toxic.
utsläppsfri Zero emissions Absolute and almost always false for a physical product across its lifecycle. It is defensible only for a narrowly defined stage that genuinely emits nothing, and the stage must be named.
koldioxidsnål Low carbon "Low" is implicitly comparative and therefore needs a disclosed benchmark. Low compared to what, measured how?
nettonoll Net zero As a present-tense product claim it is an offsetting claim. As a target it is a future-performance claim needing verifiable commitments and independent monitoring.
biobaserad Bio-based Bio-based says where the carbon came from, not that the product is compostable, recyclable or lower impact — yet consumers read all three into it.
klimatpositiv Carbon positive Claims a net beneficial climate effect. In practice it always rests on purchased credits, which point 4c rules out as a basis for any neutrality, reduction or positive-impact claim.
CO2-reducerad CO2 reduced A reduction claim is only meaningful against a stated baseline, scope and period. Without them the buyer cannot tell what was reduced or from what.
koldioxidnegativ Carbon negative An even stronger version of the neutrality claim, and equally dependent on credits. Point 4c covers neutral, reduced and positive impact claims based on offsetting.
grönare än Greener than... A comparison is only fair if the buyer can see what was compared, on which impacts, using which data. "Greener" discloses none of it.
mer hållbar More sustainable Combines the generic-claim problem with an undisclosed benchmark — vague on both the metric and the comparison set.
miljövänligare Eco-friendlier Comparative form of a term that is already too vague in its base form.
BPA-fri BPA-free BPA has been banned in food contact materials in the EU since Regulation (EU) 2024/3190. Advertising its absence as a benefit presents compliance as a distinguishing feature.
djurtestfri No animal testing Animal testing of cosmetics and their ingredients has been prohibited in the EU since 2013 under Regulation 1223/2009. For cosmetics sold in the EU this is compliance, not a differentiator.
CE-certifierad CE certified CE marking is mandatory for the product categories that require it, and it is a manufacturer's declaration, not a certification. Marketing it as a quality feature is doubly misleading.
ftalatfri Phthalate-free The main phthalates are restricted or authorisation-only under REACH Annex XVII and XIV, so for most consumer goods absence is the legal baseline.
jordvänlig Earth-friendly A planetary-scale benefit claim with no scope, no metric and no possible substantiation for an individual product.
naturvänlig Nature's friend A figurative benefit claim. Regulators read implied environmental claims the same way as explicit ones, and the figurative framing makes it harder, not easier, to substantiate.
hållbarhetsbetyg Own sustainability score A self-calculated score is a sustainability label under the Directive. Self-issued rating systems are exactly what point 2a targets.
i harmoni med naturen In harmony with nature Inte mätbart; läses som miljöfördel utan åtagande.
minska vår påverkan på miljön Lower environmental impact Jämförelse utan baslinje, omfattning eller storlek.
spara resurser Resource-saving Vilken resurs, jämfört med vad, hur mycket.
regenerativt jordbruk, regenerativ bomull Regenerative Matched as a phrase, not as a bare adjective. The adjective alone is ordinary vocabulary in technical Swedish and carries no environmental claim.

Run by the Swedish Society for Nature Conservation. A genuine independent scheme with strict criteria, and well known to Swedish consumers.

EU Ecolabel

Recognised as everywhere in the EU, though the Swan carries more weight with Swedish consumers.

Giurisprudenza

Che cosa è già stato deciso in Svezia

La storia dell’applicazione è la migliore guida disponibile su come verrà letta una dichiarazione.

Klimatneutral marketing

Swedish enforcement has focused on carbon-neutrality wording resting on offsets, which is now blacklisted outright by Annex I point 4c as amended. A shop still using it is not in a grey area.

Competitor actions

Because section 29 gives a private route, much of the Swedish caseload is competitor against competitor. The practical consequence for a shop is that the first contact may be a writ rather than a regulator's letter.

Directive 2024/825 transposition

Sweden transposes through amendments to the Marketing Act. Check the current consolidated text on riksdagen.se before relying on any specific provision — this entry has not been re-verified since 24 August 2026.
