La direttiva 2024/825 fissa le regole e lascia sanzioni e procedura agli Stati membri. È lì che vive il rischio pratico — in Germania un concorrente può portarti in tribunale in due settimane; in Italia l’autorità agisce d’ufficio e il massimale è di 10 mln €.

A small market with one central authority and, so far, little published green-claims enforcement. Low observed activity is not low legal risk, and the gap is closing on a known date: the Estonian transposition of Directive (EU) 2024/825 is adopted and enters into force on 27 September 2026 (redaction 103072026030), adding statutory definitions of 'keskkonnaväide' and 'üldine keskkonnaväide' to the Consumer Protection Act. Until then the general misleading-practice rules apply. A shop selling from Estonia into Germany is judged in Germany either way.

Svezia

Questo ha una conseguenza pratica per i testi. Una dichiarazione tradotta parola per parola può essere sicura in un mercato e contestata in un altro, perché la giurisprudenza nazionale ha già attribuito un significato a certe formule. Ogni guida elenca le formulazioni locali più rischiose.
Vende in un paese UE che non compare qui?
La direttiva 2024/825 si applica allo stesso modo in tutti i 27 Stati membri, così come la lista nera dell'allegato I che essa inserisce nella direttiva 2005/29/CE — ciò che cambia è la sanzione e la procedura, che è esattamente quanto descrivono queste otto guide. Lo scanner funziona allo stesso modo che il suo mercato sia elencato o no, e la regola transfrontaliera vale ovunque: la tutela del consumatore segue il consumatore, quindi il paese verso cui vende fissa lo standard.
